FRACTIO LOGISTICS LTDA, a private legal entity, registered with the CNPJ under nº 35.096.552/0001-20, headquartered at Rua Dr. Pedro Ferreira, 333 – Room 2401 A, Centro District, Itajaí/SC, ZIP Code 88.301-030, hereby presents this Privacy and Personal Data Processing Policy with the purpose of demonstrating its commitment to the privacy and processing of personal and/or sensitive data of its users.

In compliance with the adjustments required by the Brazilian General Data Protection Law (“LGPD” – Federal Law nº 13.709/2018), we will safeguard the privacy of user information collected and stored through interactive services on our digital media or via contact requests made available herein. Thus, Fractio undertakes to ensure and preserve your privacy and the confidentiality of your information, since it is our goal to establish a lasting and trustworthy relationship.

By accepting our Privacy and Personal Data Processing Policy, you expressly, freely, unequivocally, and knowingly consent to the terms set forth herein, authorizing the collection of personal data and information mentioned below, as well as their use for the purposes specifically indicated.   1. INFORMATION AND PERSONAL DATA THAT MAY BE COLLECTED

The information that may be collected for the exercise of our activities, as required, includes:

a) Registration or contact data: information such as name, civil identification documents, address, phone number, email, professional registration, vehicle data, among others;

b) Occupational or professional data: information related to the company you are associated with, job title or function, professional history, among others;

c) Transaction data: information related to transactions carried out with Fractio, services contracted or provided, among others;

d) Financial data: information such as bank details, remuneration history, among others;

e) Access data: connection cookies necessary to enable the basic functions of our website, such as navigation and access to pages;

f) Images: photos or videos taken by security cameras in order to ensure access control and security within the company’s premises;

g) Sensitive personal data: due to legal or regulatory requirements, or for security purposes, Fractio may collect and process certain sensitive personal data, such as biometric data for office access, or health data that attest to a service provider’s ability to perform contracted duties.

 

PURPOSES OF PROCESSING PERSONAL DATA

The use of personal data may occur for the following purposes:

a) Registration of individuals as: Candidate (Job Vacancy), Visitor, Employee, Service Provider, Client, or Supplier;

b) Granting access to Fractio’s facilities, as well as performing physical access control within its premises;

c) Access control to systems

d) Drafting and executing proposals and contracts for the provision of Fractio’s logistics services;

e) Drafting and executing proposals and contracts for the supply and provision of services to Fractio;

f) Conducting profile and/or credit assessment, fraud prevention (such as identity validation for customer service);

g) Promoting social events and professional training sessions;

h) Compliance with legal and regulatory obligations, as well as accountability to the National Data Protection Authority (ANPD);

i) Subscription to newsletters and receipt of commercial information.

 

Additionally, for purposes not listed above, we may process personal data with your consent. In such cases, this Privacy and Data Processing Policy may be supplemented by specific terms and conditions presented to you before consent is obtained.

Regarding sensitive personal data, processing will be carried out strictly to comply with Fractio’s legal and regulatory obligations, or to ensure security in electronic identification and authentication processes. Any other processing of sensitive personal data will only occur with your explicit consent (or as otherwise permitted by LGPD).

  1. DATA SHARING

Fractio may, when necessary, share your personal data with:

a) Cargo terminals;

b) Service providers: as part of Fractio’s operations, we use third-party services (e.g., cloud providers, accounting firms, law firms, etc.). As necessary, we will share your data with these third parties solely for the purposes described in this Privacy Policy;

c) Credit rating companies, for authentication, fraud prevention, and credit protection purposes;

d) Law enforcement agencies, government bodies, regulatory authorities, courts, or other public authorities, for strict compliance with legal or regulatory obligations.

In the above cases, Fractio will not be required to obtain your consent prior to sharing.

If Fractio needs to transfer your information outside of Brazil, we will adopt all necessary security measures and ensure that such transfers occur under agreements containing specific contractual clauses for this purpose, or other safeguards provided by applicable law.

  1. RIGHTS OF DATA SUBJECTS

Under the Brazilian General Data Protection Law (LGPD), data subjects have the following rights regarding personal information under Fractio’s control:

a) Obtain confirmation of whether or not we process personal data, and access the data processed by Fractio;

b) Request correction of incomplete, inaccurate, or outdated data;

c) Request anonymization, blocking, or deletion of unnecessary, excessive, or unlawfully processed data;

d) Know with whom we share your data;

e) Revoke your consent when personal data is processed under this legal basis, and request the deletion of data processed with consent, except in cases where retention is legally permitted.

Additionally, you may exercise any other rights granted by law. All requests will be processed free of charge. Fractio may, however, request proof of identification, either through confirmation of personal information, confirmation email, or in-person validation, to ensure requests are made exclusively by the data subject.

  1. INFORMATION SECURITY

Fractio is committed to adopting all types of administrative, technical, and physical preventive measures regarding security and privacy in its data processing activities. This includes employee training and awareness, as well as the use of advanced encryption and firewall technologies.

All information provided by users will be stored securely and with integrity, in a controlled, monitored, and secure environment. Information obtained will be treated as confidential and accessed only by authorized and qualified individuals at Fractio.

However, you must also adopt appropriate security measures, including the use of software or applications capable of neutralizing potential incidents, viruses, or other threats.

While browsing, you must not engage in any unlawful acts against our website or servers that may compromise their integrity or cause harm to other users. Any attempted or actual violation of our website’s security will be reported to the competent authorities, in order to assist in identifying you and applying the appropriate legal sanctions.

Data may also be retained with your consent, during the contractual relationship, and for the legally required storage period under applicable law.

We will only store and process your personal data while we have at least one lawful purpose and legal basis for doing so. At the end of the processing, and if no reason for retention exists, we will securely and permanently delete your data.

We act in accordance with best practices in the digital market. Marketing communications or customer service outreach will only be carried out with individuals who have requested to receive messages or who have previously interacted with us.

  1. APPLICABLE LAW

This Privacy Policy was drafted in accordance with Law nº 13.709/2018 (Brazilian General Data Protection Law – “LGPD”) and shall be governed and interpreted under Brazilian law, in the Portuguese language, with the Courts of the District of Itajaí/SC, where Fractio’s headquarters are located, elected as the competent forum to resolve any disputes arising from this document, except in cases of specific legal jurisdiction of personal, territorial, or functional nature under applicable legislation.
